Terms of Service

1. The service

DocketSync Online ("the Service") matches case numbers your firm submits against court calendar data that Basha Holdings LLC licenses from a North Carolina data provider, and presents the results in a web application, email digests and downloadable reports. The Service is offered to law firms and legal professionals for use in their own practice.

2. Accounts

• The person who signs up ("the Owner") must be authorized to bind the firm ("you") to these Terms and to pay for the Service.
• Sign-in is by one-time email link. You are responsible for who has access to the email addresses you attach to the firm, for keeping those addresses current, and for removing people who leave.
• You must give accurate firm and contact information and keep it up to date.

3. Trial, fees and cancellation

• Pricing is shown at sign-up and on your Account page: a monthly firm account fee plus a monthly fee per attorney seat. Prices may change with at least 30 days' notice by email; changes apply from your next billing period.
• New firms receive a 30-day free trial. A payment card is required to start the trial. The first charge is made when the trial ends unless you cancel first.
• Subscriptions renew monthly and are billed in advance through Stripe. Seat changes are prorated within the month.
• You may cancel at any time from your Account page. Cancellation takes effect at the end of the current billing period; there are no refunds for partial months. Cancelling during the trial means you are never charged.
• If a payment fails we will retry it and email you. Access may be suspended while a payment is outstanding and ended if it stays unpaid.
• Case and attorney limits are part of your plan. Adding more than your plan allows requires an additional seat.

4. Nature of the data. No official record.

• Basha Holdings LLC is not affiliated with the judicial branch of the State of North Carolina or with the North Carolina Administrative Office of the Courts and cannot provide a certified or other official record of any court proceeding.
• The official custodian of court records in each North Carolina county is the clerk of superior court of that county. Data in the Service may not reflect pending or post-disposition activity on a case, may lag the court's own records, and is not warranted to be accurate or complete by its source or by us.
• You must verify any entry with the clerk of court of the county of record before relying on it for any appearance, deadline, filing or advice to a client.
• A case shown as "no longer present in the latest calendar extract" means only that; it is not a statement that the case was continued, dismissed, disposed or otherwise resolved.
• Basha Holdings LLC is solely responsible for the content of the Service and its reports. Questions or concerns about any content must be directed to us, not to the courts or the data provider.

5. Your responsibilities

You agree that your firm and everyone you give access to will:

• use the Service only for the firm's own legitimate law-practice purposes, tracking cases in which the firm is involved or has a professional interest;
• not remove, hide or alter the disclaimers that appear in the Service and in its reports;
• not describe or represent any court or the Administrative Office of the Courts as your direct data source, and not use their names or seals in connection with DocketSync output;
• not prevent us from identifying Basha Holdings LLC / DocketSync as the source of the data if the data provider asks, and cooperate with any such inquiry;
• not redistribute, resell, publish or share bulk data from the Service outside your firm, and not use automated means to extract data from it, unless your subscription terms specifically allow it;
• not access the Service with scripts, bots, scrapers or other automated tools, not enumerate or guess case numbers to look up cases the firm does not represent, and not circumvent or exceed the usage limits shown in the Service; we may suspend or terminate accounts that do, and may notify the data provider as our agreement with it requires;
• notify us promptly at support@opspilot.to about any suspected inaccuracy in the data or any suspected unauthorized access to your account;
• not use the Service to harass, stalk, or locate any individual, and comply with all laws and rules of professional conduct that apply to you.

6. Our responsibilities

• We keep your case list private to your firm and do not share it with other customers or sell it.
• We refresh calendar data each business day when our data provider makes it available, and show you the date and time of the data you are looking at.
• We keep records of what the Service showed, to answer questions about a report later, and we log access to your account.
• We may suspend or change parts of the Service for maintenance, security, or if our data license requires it. We will tell you when we can.

7. Suspension and termination

We may suspend or end your access if you breach these Terms, if payment is not made, if required by law or by our data license, or if we discontinue the Service (with at least 30 days' notice where possible). You may end your subscription at any time as described in section 3. On termination we may delete your case list after a reasonable period.

8. Disclaimer of warranties

The Service and all data in it are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including accuracy, completeness, timeliness, fitness for a particular purpose and non-infringement. Nothing in the Service is legal advice.

9. Limitation of liability

To the fullest extent permitted by law, Basha Holdings LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any missed court date, deadline, sanction, malpractice claim, lost profits or lost data, arising from your use of or inability to use the Service or reliance on its data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the three months before the claim arose.

10. Changes to these Terms

We may update these Terms. Material changes will be announced by email or in the app at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms. The version you accepted at sign-up is recorded on your firm's account.

11. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Nash County, North Carolina.
